What types of compensation can you claim in Road Traffic Accident Claim?
You can claim 2 types of payments in a Road Traffic Accident Claim: General Damages and Special Damages.
1. General Damages
The purpose of General Damages is to compensate you for the pain and suffering you experienced as a result of personal injuries. The amount of payment for pain and suffering depends on their type and extent and previously decided cases can help to give guidelines on how much this amount should be.
2. Special Damages
The purpose of Special Damages is to compensate you for the expenses you have incurred. Typical examples of Special Damages include costs of medical fees, transport, repairs to the vehicle, hiring another vehicle while your vehicle is being repaired, loss of salary, any other actual expenses incurred and CPF savings contributions before the trial. You must make sure that you keep the original receipts for these expenses.
If the Court has decided that you must take partial responsibility for causing the accident, then your claim amount will be reduced by your proportion or percentage of liability.
3. Bereavement
The Civil Law Act [Cap 43] allows a fixed amount of $10,000.00 to be claimed for bereavement amongst the spouse, children and parents of the deceased to claim. This amount is divided amongst the total number of claimants.
